House Clearance Soho Terms and Conditions

These Terms and Conditions set out the basis on which House Clearance Soho provides waste collection, house clearance and related services to residential and commercial customers. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any service.

1. Definitions

In these Terms and Conditions, the following words have the meanings given:

Customer means the person, firm or company who requests or purchases services from House Clearance Soho.

Services means any house clearance, rubbish removal, bulky waste collection, office clearance, garden waste removal, or other related services provided by House Clearance Soho.

Waste means any items, materials, furniture, appliances, or refuse that the Customer instructs House Clearance Soho to remove and dispose of.

Agreement means the contract between House Clearance Soho and the Customer comprising these Terms and Conditions together with any confirmed booking details or written quotation.

2. Scope of Services

House Clearance Soho provides waste collection and clearance services, including but not limited to domestic house clearance, part-house clearances, garage and loft clearance, office and commercial clearance, and general rubbish removal.

The exact scope of work for each job will be based on the information provided by the Customer at the time of enquiry and confirmed in a booking confirmation or written quotation. Any items, areas or tasks not explicitly included in the agreed scope may be subject to additional charges or a separate agreement.

3. Booking Process

3.1 Enquiries may be made by telephone, email, or through any other communication method we make available. When making an enquiry, the Customer must provide accurate and complete information regarding the property type, access, volume and nature of waste, and any special requirements.

3.2 House Clearance Soho may provide an estimated price based on the information supplied. This estimate may be subject to change following an on-site assessment, inspection of the waste, or if the information initially provided is found to be inaccurate or incomplete.

3.3 A booking is only confirmed when House Clearance Soho has accepted the Customer's request, agreed a date and time, and provided either a verbal or written confirmation. House Clearance Soho reserves the right to decline any booking at its discretion.

3.4 The Customer is responsible for ensuring that the contact details and service address provided at the time of booking are correct. House Clearance Soho will not be liable for any delay or failure to perform the Services due to incorrect information supplied by the Customer.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that our operatives have safe, suitable and unobstructed access to the property and to all items that are to be cleared. This includes arranging any parking permits, entry codes, lift access, or permissions required to carry out the Services.

4.2 The Customer must be present at the property or appoint a representative with authority to make decisions about the Waste to be removed, to sign any required documents, and to make payment when due.

4.3 The Customer must ensure that items to be removed are clearly identified and that any items not to be removed are clearly separated or marked. House Clearance Soho will not be liable for the removal of items that were not intended to be removed but were not clearly distinguished from the Waste.

4.4 The Customer warrants that they either own the Waste or have full authority from the owner to request its removal and disposal. The Customer shall indemnify House Clearance Soho against any claims brought by third parties arising from the removal of items at the Customer's request.

5. Pricing, Estimates and Quotations

5.1 Prices for our Services are generally based on the volume and type of waste, the labour involved, access conditions, and any disposal costs or regulatory charges applicable.

5.2 Any estimate provided before an on-site assessment is an approximation only and does not constitute a binding quotation. The final price will be confirmed on site once our operatives have assessed the Waste and the working conditions.

5.3 Written quotations, where provided, are valid for the period stated on the quotation or, if no period is stated, for 14 days from the date of issue. Quotations may be withdrawn or amended if there is a significant change in circumstances or if incorrect information was originally provided.

5.4 If, during the course of the job, it becomes apparent that the volume or nature of Waste, or the access conditions, differ significantly from those originally described, House Clearance Soho reserves the right to revise the price. In such cases, the Customer will be informed and given the option to accept the revised price or decline further Services. If the Customer declines, charges may still apply for any work already carried out or costs incurred.

6. Payments

6.1 Unless agreed otherwise in writing, payment is due in full on completion of the Services on the day of the clearance, before our operatives leave the site.

6.2 House Clearance Soho accepts payment by cash, debit or credit card, and any other methods made available at the time of service. Cheques or bank transfers may only be accepted by prior arrangement.

6.3 For commercial Customers, or where invoices are issued by prior agreement, payment terms will be stated on the invoice. If no terms are stated, payment is due within 7 days of the invoice date.

6.4 House Clearance Soho reserves the right to charge interest on overdue amounts at the statutory rate applicable to commercial debts, accruing daily until payment is received in full.

6.5 The Customer shall not be entitled to withhold or set off any amount against sums due to House Clearance Soho, except where required by law.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by giving House Clearance Soho at least 24 hours' notice prior to the scheduled start time.

7.2 If the Customer cancels with less than 24 hours' notice, House Clearance Soho reserves the right to charge a cancellation fee, which may be up to 50 percent of the estimated price for the Services, to cover administrative costs and lost working time.

7.3 If the Customer fails to provide access to the property at the agreed time, or if the job cannot proceed for reasons within the Customer's control, this may be treated as a late cancellation and a fee may be charged.

7.4 House Clearance Soho may cancel or reschedule a booking if it is unable to perform the Services due to circumstances beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents, or safety concerns. In such cases, House Clearance Soho will seek to rearrange the booking at a mutually convenient time and will not be liable for any consequential loss suffered by the Customer.

8. Waste Handling and Regulations

8.1 House Clearance Soho operates in accordance with applicable UK waste management laws and regulations. All Waste collected will be transported and disposed of at authorised facilities, and, where possible, items may be reused or recycled.

8.2 The Customer is responsible for ensuring that no hazardous or prohibited waste is presented to House Clearance Soho without prior disclosure. Hazardous waste includes, but is not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, gas bottles, certain electrical items, and any materials classified as dangerous under applicable regulations.

8.3 If hazardous or prohibited waste is discovered during a job that was not declared in advance, House Clearance Soho may refuse to remove such items, or may agree to remove them at additional cost if permitted by law and subject to appropriate arrangements.

8.4 House Clearance Soho reserves the right to decline to handle or transport any items that, in its reasonable opinion, present a risk to health and safety, could damage property or vehicles, or cannot lawfully be handled under waste regulations.

8.5 In some cases, House Clearance Soho may issue a waste transfer note or other documentation in relation to the collection and disposal of Waste, in line with legal requirements. The Customer should retain any such documents for their records where recommended or required.

9. Liability and Limitations

9.1 House Clearance Soho will exercise reasonable care and skill in providing the Services. However, minor scuffs, marks or incidental damage may occur in the normal course of moving bulky items or waste through tight spaces. The Customer is responsible for protecting floors, walls, doorframes and other surfaces if they have particular concerns about potential minor damage.

9.2 House Clearance Soho shall not be liable for any loss or damage to items that the Customer has asked to be removed as Waste. It is the Customer's responsibility to ensure that items of value or sentimental importance are not included in the Waste.

9.3 If House Clearance Soho is found liable for loss or damage to property, its liability shall be limited to the reasonable cost of repair or replacement of the damaged item, taking into account wear, tear and depreciation, and shall not exceed the total price paid or payable for the relevant Services.

9.4 House Clearance Soho shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or any other economic loss arising out of or in connection with the Services.

9.5 Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot be excluded or limited under applicable law.

10. Insurance

10.1 House Clearance Soho maintains insurance cover appropriate to its business activities. Details of insurance cover can be provided upon reasonable request.

10.2 The existence of insurance does not extend or increase House Clearance Soho's liability beyond the limits set out in these Terms and Conditions.

11. Complaints

11.1 If the Customer has any concerns or complaints about the Services, they should notify House Clearance Soho as soon as possible, and, in any event, within 48 hours of the completion of the job.

11.2 House Clearance Soho will investigate any complaint in good faith and will seek to resolve the matter promptly. The Customer agrees to allow House Clearance Soho a reasonable opportunity to inspect and, where appropriate, remedy any alleged issue before seeking any alternative remedy.

12. Data Protection and Privacy

12.1 House Clearance Soho will collect and process personal data such as names, contact details, service addresses and payment information for the purposes of administering bookings, providing Services and complying with legal obligations.

12.2 Customer information will be handled in accordance with applicable data protection laws. House Clearance Soho will take reasonable steps to keep personal data secure and will not sell or disclose personal data to third parties except where necessary to provide the Services, process payments, or comply with legal requirements.

13. Force Majeure

13.1 House Clearance Soho shall not be in breach of this Agreement or liable for any delay or failure to perform the Services where such delay or failure results from events, circumstances or causes beyond its reasonable control. This may include, without limitation, extreme weather, fire, flood, acts of God, strikes, lock-outs, industrial disputes, civil commotion, acts of terrorism, or interruptions to transport or utilities.

13.2 In such circumstances, House Clearance Soho may suspend the Services for the duration of the event or may cancel the booking without liability, but will seek to rearrange the Service where reasonably possible.

14. Variations to Terms

14.1 House Clearance Soho may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that booking.

14.2 Any variation to these Terms and Conditions requested by the Customer shall only be effective if agreed in writing by an authorised representative of House Clearance Soho.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by House Clearance Soho.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, such provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between House Clearance Soho and the Customer and supersede any prior understandings, arrangements or representations relating to the subject matter.

17.2 The Customer acknowledges that they have not relied on any statement, promise or representation made or given on behalf of House Clearance Soho which is not set out in these Terms and Conditions or in the written quotation or booking confirmation.
